PRIVACY POLICIES

Effective as of October 1, 2020.

These Privacy Policies (“Privacy Policies”) describe the information practices of Golden Franchising Corporation (“Golden”) and its affiliates, subsidiaries and related entities such as Golden Operating Corporation (“Affiliates”), (Golden and its Affiliates are referred to herein, as the context may require, as “we”, “us”, or “our”).  These Privacy Policies apply to any information collected about you by us when you do any of the following: (i) visit a GOLDEN CHICK® branded restaurant; or (ii) use any website, mobile or tablet application, digital in-restaurant kiosk, or other online service or platform of the GOLDEN CHICK® brand, or any other Golden company that links or refers to these Privacy Policies (“Web Services”).  These Privacy Policies cover the information that Golden and its Affiliates collects about you, how we use and share this information, and your choices regarding our collection and use.

THE GOLDEN CHICK® SYSTEM

The GOLDEN CHICK® system is composed of restaurants operated by us and franchisees doing businesses under the trade name GOLDEN CHICK®.  GOLDEN CHICK® franchisees own and operate their own individual franchised businesses (“Franchisees”).  Franchisees are independent third parties, and our Privacy Policies do not apply to the privacy practices of any of these Franchisees.   Please see the section entitled Franchise Services below for more information regarding a Franchisees’ applicable policies.

INFORMATION COVERED BY PRIVACY POLICIES

Our Privacy Policies apply to information, including Personal Information, collected about you by Golden, its Affiliates, and third-party service providers.   As used in our Privacy Policies, “Personal Information” means information that personally identifies you.

Golden and its third-party service providers (including any GOLDEN CHICK® social media pages) collect information about you from a variety of sources, including information you provide directly to us, and information we collect about you when you interact with us.  We may combine any of the information collected about you for the purposes described in our Privacy Policies.

In addition, we and our third-party service providers may also collect information, including Personal Information, relating to your purchases from Golden and its Franchisees, such as the authorization code of the transaction, payment method, the date and time of the transaction, items purchased, and the purchase price.

INFORMATION COLLECTED AUTOMATICALLY

Some information is collected automatically by us and our third-party service providers using Traffic Data, Cookies, Web Beacons, and other tracking technologies.  We treat information automatically collected as non-personally identifying information.  Such information may be combined with your Personal Information so that we can improve and customize Web Services and our communications and promotions.  To the extent that information automatically collected is combined with Personal Information, we treat the combined information as Personal Information for the purposes of our Privacy Policies.

Traffic Data is information that our Web Services automatically tracks and collects such as your IP address, domain server, type of computer, and type of web browser for our marketing purposes and to manage and improve Web Services.

Cookies are small text files that are stored on a user’s computer and allow websites to remember information about users.  We use Cookies to monitor how Web Services are used, for marketing purposes, and to help personalize and improve Web Services.  Most browsers automatically accept Cookies however, you can set your browser to reject Cookies.  Please check the “Help” menu of your browser to learn how to change your Cookie preferences.

Web Beacons (also known as internet tags, pixel tags, and clear GIFs) are small bits of code embedded in pages or images on Web Services, social media pages and e-mails to identify if something has been opened, acted on, or forwarded.  You can set your browser to reject Web Beacons.  Please check the “Help” menu of your browser to learn how to change your Web Beacon preferences.

Other tracking technologies may be used, if permitted by applicable law, to collect “referrers” and various environmental variables.  A “referrer” is information the web browser passes along to our or our third-party service provider web servers, which refers to the URL from which you accessed Web Services.  Environmental variables may include, among other things, the domain used, time accessed, type of web browsers and operating system, internet address of last website, and internet address of the website you visit next.  These environmental variables are collected by most websites.  We use these technologies for marketing purposes and to optimize user’s experience with Web Services.

GOOGLE ANALYTICS

We use Google Analytics, a web analytics service provided by Google, Inc.  (“Google”), on certain Web Services.  Google Analytics collects information such as how often you visit Web Services, what pages you visit within Web Services, and what other sites you visited prior to coming to the applicable GFC Web Service.  We use the information provided by Google Analytics to improve Web Services.  For more information regarding how Google collects, uses and shares your information please visit https://policies.google.com/technologies/partner-sites.  Google provides users more choice on how their data is collected by Google Analytics by developing an Opt-out Browser Add-on which can be located at:  https://tools.google.com/dlpage/gaoptout?hl=en.  By installing this Add-on, no information is being sent to Google Analytics.

DO NOT TRACK SIGNALS

There are currently no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals.  Thus, Web Services are unable to respond to Do Not Track Signals.  We do not, however, currently track your Personal Information over time and across third-party websites.

Golden does not allow third parties to collect Personal Information about your online activities when you use Web Services for such third-party use.  We do use third-party web analytics services on Web Services, such as Google Analytics, to help us obtain and analyze information about your browsing or usage habits but this information does not include Personal Information other than your IP address.

MOBILE APPLICATIONS

We and our third-party service providers may collect additional information when you utilize any of our mobile applications, including the type of mobile device you use, the temporary or persistent unique device identifiers (sometimes called UDID), the IP address of your mobile device, your mobile operating system, the type of mobile internet browsers you use, and information about the way you use our mobile applications.  Also, if you utilize any of the location-based services in our mobile applications, such as Find a Restaurant, we and our third-party service providers may collect, use, and share location data, including the real-time geographic location of your device.  We use such information to provide and improve location-based products and services.  You may opt-out from further allowing us to have access to your location data by adjusting the permissions in your mobile device.

USE OF INFORMATION

We use your information that we collect, including Personal Information, for a variety of business purposes, including:

  • to provide and manage the products and services you request;
  • to operate and manage our stored-value card program;
  • to create and manage any accounts you have with us (i.e., e-mail list, online registration for events, online ordering, mobile payments, etc.);
  • to respond to your inquiries, comments, stories, or postings;
  • to communicate with you about our products, services, and promotions;
  • to delivering targeted advertising, promotions, and offers;
  • to understand our customers so we can develop and improve our customer service, promotions, products, and services;
  • to enforcing our Terms and Conditions and protecting our Web Services; and
  • to otherwise use information with your consent or at your direction.

SHARING AND DISCLOSURE OF INFORMATION

We share and disclose your Personal Information under the following circumstances:

  • to Affiliates so they may provide offers that may be relevant to you, better understand your preferences, and improve our services;
  • to Franchisees who are working with us in delivering services to you (i.e., delivery and take-out services) or providing local offers or promotions;
  • to business partners to provide services that you request (however, we are not responsible for the privacy practices of these entities and recommend you review their privacy policies carefully);
  • to service providers who are providing services on our behalf (i.e., payment, delivery, hosting, advertising, data analytics, and marketing companies);
  • to social media services if you connect a social media account with our Web Services or engage with our services through a social media platform (however, we are not responsible for the privacy practices of the social media services and recommend you review their privacy policies carefully);
  • to other parties when required or permitted by law, or as necessary to protect us, our Affiliates, users and services;
  • to other parties in connection with a corporate transaction in the event that we sell or transfer all or a portion of our business or assets to a third party;
  • to other parties who are using aggregated information (excluding any personal identifiers) to describe how our customers are using our services; and
  • to other parties whenever you consent to or direct such sharing.

We do not “sell”, as defined in applicable state laws/regulations, your Personal Information to any third parties for monetary or other financial considerations and have not done so within the previous 12-month period from the date listed on these Privacy Policies.

PERSONAL INFORMATION OF PROSPECTIVE EMPLOYEES

We collect Personal Information that you provide in connection with any employment application with our Affiliate Golden Operating Corporation.  Third parties are also used to supplement, update, verify and process your employment application with Golden Operating Corporation.  By applying to become an employee of Golden Operating Corporation you will be consenting to our collection, use, and disclosure of your Personal Information, and authorizing a third party to share your Personal Information with us.

PERSONAL INFORMATION OF PROSPECTIVE FRANCHISEES

We collect Personal Information that you provide in connection with any franchise application with us.  Third parties are also used to supplement, update, verify and process your franchise application with us.  By applying to become a franchisee of ours you will be consenting to our collection, use, and disclosure of your Personal Information, and authorizing a third party to share your Personal Information with us.

PRIVACY AND ACCESS CHOICES AVAILABLE TO YOU

We provide you with the opportunity to update and/or delete certain information and to opt-out of having your Personal Information used or disclosed for certain purposes.  For example, you may

  • correct, update, and delete your online accounts;
  • change your choices for subscriptions and certain communications (i.e., e-mail list and other notifications);
  • choose whether to receive Promotions and offers from us;
  • request that we do not share your Personal Information with third parties for their marketing purposes; and/or
  • request access to your Personal Information.

You may exercise your choices by contacting us via the Contact Information provided at the end of these Privacy Policies, or following instructions provided in communications sent to you.

Since we plan our communications in advance, it may take several weeks for your request to become effective.  Please let us know if you continue to receive our communications after expressing an opt-out preference so we can investigate the situation.

Finally, please be aware that if you do not allow us to collect and use your Personal Information, we may not be able to deliver certain products, services, Promotions, and offerings to you.

CHILDREN’S PRIVACY

We do not knowingly collect Personal Information online from children under the age of 13 without parental or guardian consent, unless permitted by law.  Please contact us via the Contact Information provided below if you believe we may have collected such information without parental or guardian consent or other than in a manner authorized by law, and we will take all necessary steps delete it.

INFORMATION SECURITY

We have implemented reasonable technical, administrative, and physical safeguards to help us protect your Personal Information from unauthorized access, use, and disclosure.  When we collect or transmit sensitive information such as a credit card number, we use industry standard methods to protect that information.  We also request that our third-party service providers use commercially reasonable security measures to protect your information from unauthorized access or use.  However, as effective as these measures are, no security system is impenetrable.  We cannot guarantee the security of the Web Services provided by us or our third-party service providers, nor can we guarantee that the information you provide will not be intercepted while being transmitted to us over the internet.

THIRD-PARTY WEBSITES AND SERVICES

Our Web Services may link to third-party websites and services that we do not operate and are outside of our control.  We are not responsible for the security or privacy of any information collected by other websites or other services.  Please exercise caution and review the privacy statements applicable to the third-party websites and services you use.

FRANCHISE SERVICES

Franchisees of GOLDEN CHICK® are independent third parties and may own, operate, and maintain a website, mobile application, social media page, or other online service for his, her, or its franchised restaurant business (“Franchise Services”).  Our Privacy Policies do not apply to the privacy practices of any Franchisees.  Therefore, you should carefully review the privacy policies of each Franchise Services that you visit.  Questions or concerns regarding any Franchise Services should be directed to the applicable Franchisees.

We may allow a Franchisees to link to Web Services subject to certain terms and conditions.  Golden, however, is not responsible or liable for any Franchise Services, even if it is linked to this Site, or for any Franchisees’ online conduct and privacy practices.

MODIFICATIONS TO PRIVACY POLICIES

We reserve the right at any time to update, change, modify, or revise these Privacy Policies.  Any changes will become effective upon posting the updated policies to our Web Services.  Your continued access to or use of our Web Services and its programs and offers after any such changes indicates your acceptance of the Privacy Policies as modified.  It is your responsibility to review the Privacy Policies regularly for updates.
